Terms and Conditions for NDS Trade-In Program



NDS Trade-InNDS Trade-In Terms and Conditions for NDS Trade In programNDS Trade In is a service provided by NDS’s third-party trade-in vendor.  By accepting the Trade in Terms and Conditions, you understand and agree that:


You are at least the age of majority.

This trade-in service is offered and provided by NDS’s third-party trade-in vendor (“Vendor”).

You are not a reseller and you either own the trade-in device or have been authorized by such owner to trade in the device.

NDS or Vendor may refuse, cancel, or limit the quantity of any trade-in transaction for any reason.

There are no leases, contractual commitments, or other third-party interests attached to your trade-in device.

At the completion of this transaction, ownership of your device transfers to Vendor, and you assign to NDS the right to collect from Vendor the value you receive.

You are responsible for backing up and/or deleting data on your trade-in device. Neither Vendor nor NDS will be liable for your data.

You acknowledge that trade eligibility and trade values are subject to our Vendor’s inspection. There may be instances when the Vendor will revise the original quote for the trade-in device if inspection results differ from what was described, if data is not removed, or if the trade is not received within 14 days of trade-in box delivery. If the quoted trade-in value changes, you will be contacted to accept or decline the revised price.

You acknowledge and agree that the trade-in transaction is final and cannot be canceled by you unless the quoted value has been revised and declined by you.

Laws may require that any personal information you provide as part of this trade in be provided to law enforcement by Vendor and/or NDS.



1. Accept/Confirm order

NDS may, at its sole discretion, refuse or cancel any order and limit order quantities. NDS may require additional eligibility information before accepting or processing any order.
Once we receive your Online or Call Center order, we will provide you with an order confirmation by email. However, your receipt of an order confirmation does not mean that NDS accepts your order nor does it constitute confirmation of our offer to sell, and we are simply confirming that we have received your order.
NDS reserves the right to accept or decline your order at any time after receipt of your order for any reason. If NDS cancels your order after you have been invoiced, NDS will refund the invoiced amount.

 
2. Order and payment.

2.1 Payment

Payment terms are at the sole discretion of NDS, payment details must be received before NDS accepts an order.

2.2 Payment method.

NDS allows you to make purchases or place orders (request security for the return of the replaced part or product) with cash, credit card, debit card, or bank transfer where applicable and accepted in the country. country where services are provided or some other pre-arranged payment method unless NDS agrees to some other terms.
When you provide NDS with your card information, NDS will obtain pre-approval from the card company for the amount of the order, which may result in a corresponding block of your available credit while prior approval is still in effect.
NDS will not bill your credit card or process your debit card or wire transfer transaction until your order has been processed. NDS may not accept credit cards, debit cards or wire transfers linked to billing addresses outside the country where the purchase or order was made.

2.3 Price.

NDS offers you competitive prices on our current products and services. The total price of your order will include the price of the product or service on the date the order is processed. NDS reserves the right to change the prices of the products or services displayed at any time and, in particular, to correct pricing errors that appear. Price changes will not affect services that have already begun.

2.4 Confirmation.

NDS will send you order confirmation via SMS/Email immediately upon receipt. You will receive confirmation by regular mail or via email when NDS accepts your order.

2.5 Refunds.

Except as described in the Warranty and Limitation of Liability section below, NDS does not provide refunds for service orders.

3. Warranty and limitation of liability

3.1 Service warranty.

For all service orders, NDS warrants that
Services performed will comply with the description for ten years (15) days from the date of service,
All parts or products used in service shall be free from defects in materials and workmanship for ten years (15) days from the date of service

  1. Re-perform the services to conform to their description
  2. Repair or replace parts or products, using parts or products that include new and/or previously used genuine parts that have been tested and meet the requirements function


4. Shipping & Delivery

Actual delivery may be affected by events beyond NDS's control once an order leaves our facilities, so NDS accepts no liability for late delivery. However, We will work with the Carrier and you to ensure a smooth delivery.
NDS undertakes the transportation of the products you purchase from Us so that the risk of loss or damage to the products passes to you when you or a person you designate acquires physical possession of the products.
Product information will be transferred to you when the products are received by the carrier from our warehouse. At this time, you will receive an Email/Phone/SMS notification of your Order.
If there are any problems with delivery, please contact NDS to resolve them.
